The Key Questions Your Alabama Estate Plan Needs to Answer in the New Year

Are you confident that your Alabama estate plan covers all the critical tools it should? Whether you are crafting an estate plan for the first time or revisiting an old one, knowing what should be included is crucial for ensuring your wishes are honored and your loved ones are protected.

But, where should you start? Your Alabama estate planning is about more than just drafting a last will and testament; it is about creating a roadmap for you and your family’s future. From healthcare planning tools to durable powers of attorney, each piece of your plan serves a specific purpose. When you choose to work with an experienced Alabama estate planning attorney they can show you that just by including these essential documents, you can create a comprehensive estate plan that leaves no room for uncertainty.

A solid estate plan does not only plan for the end of your life, but also protects you during it. When you work with your experienced Alabama estate planning attorney, they are going to discuss with you the importance of a last will and testament, which ensures your assets are distributed according to your wishes. In addition, they will also discuss many more tools to ensure you are protected against future uncertainty.

For example, when you choose to add an Alabama power of attorney you are granting someone the authority to manage your financial affairs if you become incapacitated. What would happen right now if you were in a car accident? Is there someone who could step in to handle:

• Paying your mortgage,

• Ensuring you get paid,

• Picking up your kids from school, or

• Your household expenses?

By contrast, your attorney may also talk to you about your healthcare planning, focusing on who should make your health care decisions when you are unable to. From including a living will to ensuring you choose your health care decision maker to outlining your medical preferences, there is much to discuss.

For many of us, a last will and testament will not be enough to ensure we can reach our goals for ourselves, our family, and our legacy. Your experienced Alabama attorney may also recommend a trust agreement which can be another critical component of your estate plan. Your trust agreement may not only help your family bypass the probate process, but allow you to maintain privacy and control over your assets long after you are gone.

You may also want to discuss your beneficiary designations on accounts such as life insurance, retirement funds or savings accounts with your attorney to ensure that those designations align with your estate plan. By being proactive, and ensuring you have your Alabama estate plan in place, you will not only give your family peace of mind but also avoid unnecessary legal complications.
